On August 16th, 2016, Toledo's city council passed legislation to protect children from exposure to the common house hold lead hazard of deteriorating paint. Deteriorating paint is common in older homes, and it's a leading cause of lead poisoning in young children to this day. The Lead Safe Residential requirements in Toledo are a great start in combating the threat of lead poisoning via paint.
So who's affected by this ordinance? Property owners and owners of in-home child care facilities. If a structure is a single-family, duplex or family child care center and build before 1978, it must be inspected.
So if I get inspected, then what happens?
- If no visual chipping,cracking, peeling, chalking paint is found,then dust wipes are collected. If the wipes are below allowed levels, then a lead safe certificate will be issued-and no remediation is needed.
- If properties fail visual or dust inspection, the problem area's must be put into "LEAD SAFE" condition, as outlined by the ordinance measures.
- The Lead Safe ordinance does NOT require lead paint, (for example) , to be completely removed, as it is costly. The scope of testing is intended to be simple, fast, effective, and low cost.
How long do I have to comply?
The measure went into effect on September 16th, 2016 giving landlords one year to get their properties inspected and to have hazards contained to be in compliance. Owners of more than 10 properties may request an additional year to comply as long as they’ve registered 10 properties before the September 16th, 2017 deadline.
